Chapter 11 - The Floor Did Not Raise a Belt
The defense expert testified at a pretrial hearing.
He used technical language to create distance from what everyone had seen.
He described velocity.
Angle.
Surface hardness.
He claimed Lily’s injury resulted from the impact with tile rather than the belt.
The prosecutor asked one question.
“Would Lily have struck the floor if Mr. Hutchinson had not raised and swung the belt?”
The expert hesitated.
“That is outside my medical analysis.”
The judge looked unimpressed.
Dr. Chen testified next.
“The belt caused the child to recoil.”
“The recoil caused the fall.”
“The fall caused the fracture.”
“These are not separate events.”
“They are one continuous act of violence.”
The court allowed the aggravated child-abuse charge to proceed.
Gerald’s attorney changed strategy.
He offered a plea agreement.
Three years in prison.
No admission of intentional abuse.
No testimony about the correction room.
The prosecutor rejected it after consulting us.
James asked what I wanted.
“I want Lily never to believe what happened was an accident.”
The trial was scheduled for six weeks later.
During that time, Lily returned home.
She wore a protective helmet during therapy.
She tired easily.
Sudden noises frightened her.
The first time James opened his belt after work, she crawled beneath the dining table.
He stopped wearing belts.
We removed every one from the house.
A therapist helped Lily understand that fear could stay after danger left.
One evening, she asked why Patricia had said she deserved it.
I sat beside her bed.
“Grandma learned something wrong a long time ago.”
“Why didn’t she learn something right?”
“Because learning something right would mean admitting she hurt people.”
Lily considered that.
“Can she say sorry?”
“She can.”
“Will she?”
“I don’t know.”
Lily looked at her stuffed elephant.
“I don’t want to see her even if she does.”
“You do not have to.”
That was the promise my parents never gave me.
The right to refuse access to someone who caused harm.
The night before trial, Detective Ruiz called.
