Chapter 14 - THE CUSTODY HEARING
The courtroom was closed to the public.
Sarah sat beside her attorney.
Nathan sat behind her with Rosa.
Marcus appeared through a secure video connection from jail.
His face was bruised from the lodge arrest, but his voice remained controlled.
His attorney argued that criminal accusations did not automatically terminate parental rights.
He claimed Sarah had influenced Lily’s memories.
He described the blizzard escape as evidence of Sarah’s reckless parenting.
“She sent a barefoot child into deadly weather,” he said.
Sarah’s attorney stood.
“She sent the child toward the only safe adult available while Marcus Kane stood over her with a broken bottle.”
The judge reviewed hospital reports, security footage, and Lily’s forensic interview.
Lily did not testify in the courtroom.
A child specialist recorded her answers in a separate room.
“Why did you leave the house?” the specialist asked.
“Daddy hurt Mommy.”
“Did your mother tell you to take the twins?”
“Yes.”
“Were you afraid outside?”
“Yes.”
“Why didn’t you return?”
Lily looked directly at the camera.
“Because the storm was safer.”
The judge watched the recording twice.
Marcus’s attorney asked for the statement to be excluded.
The request was denied.
Sarah testified about seven years of control.
She described forged letters, stolen phones, false medical records, and violence.
Marcus watched without emotion.
During cross-examination, his attorney asked why Sarah remained in the marriage.
She answered carefully.
“Because leaving an abuser is not one decision.”
“It is hundreds of decisions made while someone punishes every attempt.”
“Why did you not contact your wealthy brother?”
“I did.”
“Why did he not help?”
“He never received the messages.”
“Is it possible he ignored them?”
Nathan lowered his eyes.
Sarah looked at him.
“It is possible.”
The answer hurt because it was honest.
“But the evidence proves Marcus intercepted them.”
The judge suspended Marcus’s parental rights immediately.
A permanent termination hearing would follow the criminal trial.
Sarah retained full custody.
Nathan was named emergency guardian if she became unable to care for the children.
Outside the courtroom, Nathan apologized.
“You could have said I would have helped if I knew.”
“I don’t know whether you would have.”
He absorbed the words.
Sarah continued.
“The brother you are now would.”
“The brother you were seven years ago might have closed the door.”
Nathan looked toward Lily.
“I cannot change that man.”
“No.”
“But you can stop pretending he never existed.”
